I certify that I hold the seller's permit listed above, and that I will resell the items described in the regular course of my business before making any use of them other than demonstration and display. If I use them any other way, I will owe use tax based on their purchase price.
For your information: under Revenue and Taxation Code section 6094.5, a person may be guilty of a misdemeanor if they know at the time of purchase they will not resell the item and furnish a resale certificate to avoid paying tax. A person misusing a resale certificate for personal gain or to evade tax is liable, for each purchase, for the tax that would have been due plus a penalty of 10 percent of the tax or $500, whichever is more.
